Sutro Footwear is owned and operated by Miami Labs, Inc. (d/b/a OpenStore). This Privacy Notice describes how Sutro Footwear together with OpenStore and our subsidiaries and affiliated companies (collectively, “OpenStore” “we,” “us,” or “our”) collects, uses, and shares personal information. This Privacy Notice applies to information we collect when you access or use our websites, mobile applications, and other online products and services (collectively, our “Services”), or when you otherwise interact with us, such as through our customer support channels or on social media pages.

We may change this Privacy Notice from time to time. If we make changes, we will notify you by revising the date at the top of this policy. We may also provide you with additional notice (such as by adding a statement to the Services (defined below) or sending you a notification), such as in connection with making material changes to this Privacy Notice. This information may include identifiers such as real name, alias, postal address, or other similar identifiers, and inferences reflecting your consumer preferences, characteristics, and predispositions. Additionally, if applicable, if you create or log into your account with us through a third-party application, such as an app store, a third-party login service, or a social networking site, we will have access to certain information from that application, such as your name, birthday, and profile picture, in accordance with the authorization procedures determined by such application.

We also work with third parties to serve ads to you as part of customized campaigns on third-party platforms (such as Facebook and Instagram). The California Consumer Privacy Act of 2018 (Cal. Civ. Code § 1798.100 et seq.) (“CCPA”) provides consumers residing in California with certain rights with respect to their personal information. If you are a California resident, this section applies to you.

Additional Privacy Rights for California Residents

“Sales” of Personal Information under the CCPA. For purposes of the CCPA, we do not “sell” personal information, nor do we knowingly “sell” personal information about consumers under 16 years of age. We may, however, share information between and among other merchants owned and operated by OpenStore. We also allow our advertising partners to collect certain device identifiers and electronic network activity via our Services to show ads that are targeted to your interests. To opt out of having your personal information used for targeted advertising purposes, please see the “Advertising and Analytics Provided by Others” section above.

Subject to certain limitations, you have the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, and disclose, (2) request deletion of your personal information, (3) opt out of any “sales” of your personal information that may be occurring, and (4) not be discriminated against for exercising these rights. You may make these requests by contacting us as set forth in the “Contact Us” section below. We will verify your request by asking you to provide information related to your recent interactions with us, such as asking you to answer questions regarding your account and use of our Services. We will not discriminate against you if you exercise your rights under the CCPA.

If we receive your request from an authorized agent and they do not provide a valid power of attorney, we may ask the authorized agent to provide proof that you gave the agent signed permission to submit the request to exercise rights on your behalf. In the absence of a valid power of attorney, we may also require you to verify your own identity directly with us or confirm to us that you otherwise provided the authorized agent permission to submit the request.   1. SUPPLEMENTAL NOTICE FOR NEVADA RESIDENTS

If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A. If you have any questions, please contact us as set forth below.

The Services are not directed to children under 13 (or other age as required by local law), and we do not knowingly collect personal information from children.

If you are a parent or guardian and believe your child has uploaded personal information to our site without your consent, you may contact us as described in “Contact Us” below. If we become aware that a child has provided us with personal information in violation of applicable law, we will delete any personal information we have collected, unless we have a legal obligation to keep it, and terminate the child’s account if applicable.
